These Terms of Service ("Terms") form a binding contract between you and Will Miraglia ("we", "us", "FlickMe") and govern your use of the FlickMe mobile application (the "App") and any related services (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
These Terms incorporate by reference the Privacy Policy and the Community Guidelines.
You may use FlickMe only if you are at least 13 years old. By creating an account you represent and warrant that you meet this age requirement. If you are under the age of majority in your jurisdiction, your parent or legal guardian must read and agree to these Terms on your behalf.
If we learn that an account belongs to a user under 13, we will delete the account and any associated content.
You agree not to use the Service to:
We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or the Community Guidelines.
You retain ownership of the photos, captions, and messages you send through the Service ("Your Content"). However, by submitting Your Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and (where necessary for the operation of the Service) copy Your Content solely for the purpose of operating, providing, and improving the Service. This license ends when Your Content is deleted from our servers, except to the extent we must retain it to comply with law or enforce these Terms.
You represent that you have all rights necessary to grant this license and that Your Content does not violate any third party's rights.
We do not pre-screen Your Content but we reserve the right (not the obligation) to remove any content that violates these Terms or the Community Guidelines. Reports can be submitted in-app via Long-press → Report or by emailing support@flickmeapp.com. We aim to respond to reports within 24 hours.
Flicks are designed to be ephemeral — we delete them from our servers 24 hours after sending or immediately after the recipient views them. However, we cannot prevent recipients from screenshotting, screen-recording, or photographing flicks with another device. Do not send anything you would not want preserved.
We provide the Service "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or secure. We may modify, suspend, or discontinue any part of the Service at any time without notice.
You may terminate your account at any time via Profile → Delete Account in the App or by emailing support@flickmeapp.com. Upon termination, your account, flicks, chat messages, and friendship records will be deleted within 30 days (subject to the retention exceptions described in the Privacy Policy).
We may terminate or suspend your account immediately if you violate these Terms, the Community Guidelines, or any applicable law, or if we are required to do so by law.
Sections 4 (license to user content already shared with others), 5, 8, 9, 10, 11, and 12 survive termination.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT FLICKS WILL BE PERMANENTLY UNAVAILABLE TO RECIPIENTS AFTER VIEWING. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THESE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
This section does not limit liability that cannot be excluded under applicable law (including liability for death, personal injury caused by negligence, or fraud).
You agree to indemnify and hold harmless Will Miraglia and any agents from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third party's rights.
The following terms apply when you obtain the App from Apple's App Store. They are required by Apple's developer agreement and are in addition to our other Terms:
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona for any dispute that is not subject to arbitration.
Informal resolution first. Before filing any claim, you agree to first contact us at support@flickmeapp.com and try in good faith to resolve the dispute for at least 30 days.
We may update these Terms from time to time. If the changes are material, we will notify you in-app and/or by email at least 7 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance.
